EQUINE ACTIVITY LIABILITY WAIVER, RELEASE, HOLD HARMLESS, AND ASSUMPTION OF RISK AGREEMENT
By accessing, purchasing, viewing, or participating in this course, I acknowledge and agree to the following:
1. ASSUMPTION OF RISK
I understand that equine activities involve inherent risks that may result in property damage, serious bodily injury, illness, permanent disability, emotional trauma, or death to myself, my horse, or others. I voluntarily assume all risks associated with participation in this course and any related equine activities.
2. EDUCATIONAL PURPOSES ONLY
I understand that this course is provided for educational and informational purposes only and does not constitute veterinary, medical, therapeutic, or professional training advice specific to my horse or situation. I am solely responsible for evaluating whether the techniques presented are appropriate for my horse, equipment, environment, and skill level.
3. RELEASE OF LIABILITY
To the fullest extent permitted by law, I release and discharge EQUINE PERFORMANCE SOLUTIONS, LLC, its owners, instructors, contractors, employees, affiliates, agents, successors, and representatives from any and all claims, liabilities, demands, damages, causes of action, costs, or expenses arising out of or related to my participation in this course or implementation of any techniques presented.
4. HOLD HARMLESS AND INDEMNIFICATION
I agree to indemnify, defend, and hold harmless EQUINE PERFORMANCE SOLUTIONS LLC and its representatives from and against any claims, losses, liabilities, damages, legal fees, or expenses arising from my participation in this course, my actions, or the actions of my horse.
5. NO GUARANTEES
I understand that individual results may vary and no guarantees are made regarding horse performance, rehabilitation outcomes, behavioral changes, rider safety, or training success.
6. GOVERNING LAW
This Agreement shall be governed by and interpreted under the laws of the State of Florida, United States, without regard to conflict of law principles.
7. GLOBAL PARTICIPANTS
I understand that I am participating voluntarily regardless of my country of residence and agree that any disputes relating to this course shall be resolved under Florida, USA law.
8. PRICING, REFUNDS, AND COURSE MODIFICATIONS
Pricing: All course prices are listed at the time of purchase. Prices are subject to change at any time without prior notice. Any price changes will apply only to future purchases and will not affect previously completed transactions.
Refund Policy: All course sales are final. We do not offer refunds, returns, or partial credits for any reason, including but not limited to dissatisfaction with course content, changes in personal circumstances, or failure to complete the course. If you have questions or concerns about the course, please contact us directly. We are always happy to assist and ensure you get the most value from your learning experience.
Course Modifications: We reserve the right to modify, update, or adjust any aspect of the course at any time. This includes, but is not limited to, lesson content, structure, delivery format, supplemental materials, and access methods. Such modifications are made to improve the learning experience and maintain course quality.
Course Retirement: We may retire or discontinue a course at any time. When possible, all reasonable efforts will be made to provide advance notice to enrolled students. Continued access to retired courses is not guaranteed unless explicitly stated.
9. ACKNOWLEDGMENT
By checking the acceptance box, accessing the course, or continuing participation, I acknowledge that I have read, understood, and voluntarily agree to be bound by this Agreement.
10. INTELLECTUAL PROPERTY & COURSE USE
All course materials, including but not limited to videos, written content, downloadable resources, images, worksheets, teaching methods, and any related materials provided within this course, are the intellectual property of Equine Performance Solutions, LLC and are protected by copyright law.
Purchase of this course grants the purchaser a single, non-transferable license for personal use only.
Course materials may not be copied, reproduced, distributed, shared, sold, taught, or otherwise used for commercial or educational purposes without prior written permission from Louise (Vicke) McCall.
Unauthorized sharing, duplication, or distribution of any course content may result in termination of access without refund and may be subject to legal action.
